CCPA (California Consumer Privacy Act) Privacy Notice
JMA is committed to maintaining the trust and confidence of our clients and employees. JMA will not knowingly collect or use Personal Information in any manner not consistent with this policy, as it may be amended from time to time, and applicable laws.
This Privacy Notice supplements the information contained in the Privacy Policy of JMA Human Resource Management (“JMA”) and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”) when you visit the JMA website or receive JMA services (collectively, our “Services”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws.
Consistent with the CCPA, information concerning job applicants and current and former employees (collectively, “Personnel”), and subjects of certain business-to-business communications acting solely in their capacity (“B2B data subjects”) as representatives of another business is exempt from some or all of the requirements of the CCPA.
Categories of Personal Information Collected
Identifiers, such as name, contact information, online identifiers and Social Security numbers and other government-issued ID numbers
Personal information, as defined in the California consumer records law, such as name, contact information, insurance policy number, education, employment, employment history financial information, medical information and health information
Characteristics of protected classifications under California or federal law, such as sex, age, race, religion, national origin, disability, medical conditions and information, citizenship, immigration status and martial status
Commercial information, such as transaction information, purchase history and financial details
Internet or network activity information, such as browsing history and interactions with our website, applications or systems
Geolocation data, such as device location
Sensory information, such as images and audio, video or call recordings created in connection with our business activities
Professional or employment-related information, such as work history and prior employer, human resources data and data necessary for benefits and related administrative services
Education information subject to the federal Family Educational Rights and Privacy Act, such as student records
Use of Personal Information
1. To comply with state and federal law and regulations;
2. To process payroll;
3. To track time and attendance;
4. To manage workers’ compensation claims;
5. To administer and maintain benefits, including group health insurance;
6. To administer and maintain retirement service;
7. To manage employee performance of their job duties, including promotions, discipline, and/or termination;
8. To conduct workplace investigations;
9. To evaluate job applicants and candidates for employment;
10. To obtain and verify background checks;
11. To implement, monitor, and manage electronic security measures on devices that are used to access networks and systems (e.g., incident management);
12. To engage in corporate transactions requiring review of employee records, such as for evaluating potential mergers and acquisitions of the Company;
13. To maintain commercial insurance policies and coverages, including for workers’ compensation and other liability insurance;
14. To anonymize and/or aggregate data to perform workforce analytics, data analytics, and benchmarking.
California Consumer Privacy Rights
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
• The categories of personal information we collected about you
• Our business or commercial purpose for collecting that personal information
• The categories of third parties with whom we share that personal information
• The specific pieces of personal information we collected about you
Deletion Request Rights
You have the right to request that we delete any of your personal information we collected from you and retained, subject to certain exceptions permitted by law. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
JMA will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
Non-Discrimination
You have the right to not receive discriminatory treatment for exercising your CCPA privacy rights. We do not use the fact that you have exercised or requested to exercise any CCPA rights for any purpose other than facilitating a response to your request.
Exercising Your Rights
To exercise the access and deletion rights described above, please submit a verifiable consumer request to us by email at info@jmahrm.com. We will use the information you provide, and may request additional information, to confirm your identity before we process your request. You may submit a request through an authorized agent acting on your behalf. Authorized agents must have, and provide us with, written permission to make a request on your behalf and must provide necessary information to verify your own identity directly with us. We will require any purported authorized agent to submit proof of authorization to make requests on your behalf.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Changes to Our Privacy Notice
We reserve the right to amend this Privacy Notice at our discretion and at any time. The date this Privacy Notice was last updated is identified at the bottom of this page. You are advised to visit the JMA website and this Privacy Notice periodically for any changes.
